Behind every winning legal complaint is a solid structure of clear, compelling facts. Factual allegations are the backbone of any civil lawsuit—without them, even the most justified claims can fall apart in court.
This guide explains why factual allegations matter, how to write them effectively, and what mistakes to avoid if you want your complaint to hold weight.
Factual allegations are the non-conclusory, event-based statements in your complaint that tell the story behind the legal claims. They:
Describe what happened, who did it, and when
Explain how the defendant’s actions caused harm
Support each cause of action with concrete, believable events
Courts don’t need every piece of evidence—but they do need a coherent narrative supported by plausible facts.
Legal claims require factual support. A breach of contract, for example, needs facts showing a contract existed, it was breached, and the plaintiff was harmed.
Complaints without sufficient factual support risk dismissal under Federal Rule 12(b)(6) or similar motions at the state level.
Judges and clerks review hundreds of complaints. A well-drafted factual section frames your case in a persuasive, easy-to-follow way.

Avoid generalities like:

Under Federal Rule 8, allegations must rise above speculation and suggest a “plausible” legal claim.
Claims like fraud, securities violations, or RICO must meet Federal Rule 9(b):
“State with particularity the circumstances constituting fraud.”
Translation: Include the who, what, when, where, and how.
✔ Use dates, names, places
✔ Organize clearly—by event or topic
✔ Avoid legal jargon masquerading as facts
✔ Reference—but don’t necessarily attach—supporting documents
✔ Tie each fact to a claim or element
